The short version

Our apps are sold through the App Store: either paid once up front, or free with a one-time unlock. No subscriptions.
What you create with our apps is yours.
Content we include, such as the PosePlan pose library, is for your personal use inside the app.
Automatic results (captions, EXIF details, light times) are helpful estimates. Please check them before relying on or publishing them.

1. About these terms

These Terms of Use ("Terms") apply to PosePlan, Photo Border, FrameForge and CaptionForge (the "Apps") and to this website, provided by FilmPix Studios Limited, Cork, Ireland ("we", "us"). By downloading or using an App you agree to these Terms.

The Apps are licensed to you through the Apple App Store. Apple's Licensed Application End User Licence Agreement (the "Apple EULA") also applies. If these Terms and the Apple EULA conflict, the Apple EULA applies to the extent of the conflict.

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use each App you obtain on Apple devices that you own or control, as permitted by the App Store usage rules (including Family Sharing where available). You may not copy, modify, reverse engineer, resell or distribute the Apps, except where the law allows this regardless of these Terms.

3. Purchases

Paid apps: Photo Border, FrameForge and CaptionForge are paid for once, up front, on the App Store.
PosePlan is free to download with a limited selection of poses. A one-time in-app purchase unlocks the full library and unlimited poses of your own. Content added in future updates is included while we continue to offer it.
Prices are shown on the App Store and in the app before you buy, in your local currency. Purchases are processed by Apple and linked to your Apple Account, and can be restored on your other devices.
Refunds are handled by Apple. You can request one at reportaproblem.apple.com.

4. Your content

You keep all rights to the photos, videos, captions, notes and other content you create or open with our Apps. That content stays on your device and we do not receive it. Please only use content you have the right to use, and get consent from the people you photograph or film.

5. Content we provide

The poses in PosePlan, and any templates, presets or other material included in our Apps, are licensed to FilmPix Studios. You may use them inside the Apps for your own shoots and projects. You may not extract, copy, sell, publish or redistribute them, or use them to train or build other products or datasets.

6. Automatic results

CaptionForge generates captions automatically. Speech recognition is not perfect, so review captions and timing before you publish.
Photo Border and FrameForge display metadata stored in your photos. Its accuracy depends on your camera. EXIF can include the date and location of a photo, so check the details you show before sharing publicly.
PosePlan calculates sunrise, sunset, golden hour and blue hour on your device using astronomical formulas. These are estimates that can differ because of terrain, buildings and weather. Map information is provided by Apple Maps.

7. Acceptable use

Please use our Apps lawfully and respectfully. Do not use them to create content that infringes someone else's rights or breaks the law.

8. Availability and changes

We work to keep our Apps reliable and up to date, but we may change, add or remove features, or stop offering an App, over time. We may update these Terms. If we make significant changes we will update the effective date above. Continuing to use an App after a change means you accept the updated Terms.

9. Disclaimer

The Apps are provided "as is" and "as available". To the fullest extent permitted by law, we do not guarantee that they will be uninterrupted or error-free, or that they will meet every requirement you have.

10. Liability

To the fullest extent permitted by law, FilmPix Studios will not be liable for any indirect or consequential loss, or for loss of data, profits, bookings or business, arising from your use of the Apps. Our total liability to you for any claim relating to an App is limited to the amount you paid for that App or its in-app purchase.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

11. Your consumer rights

If you are a consumer, you have legal rights under the laws of Ireland and the European Union, including rights relating to digital content that is faulty or not as described. Nothing in these Terms affects those statutory rights.

12. Governing law

These Terms are governed by the laws of Ireland and the courts of Ireland have jurisdiction. If you are a consumer living elsewhere in the European Union, you may also bring proceedings in the courts of the country where you live, and you keep the protection of that country's mandatory consumer laws.
